PIALA INC. fully recognizes its social responsibilities to protect all personal information handled in its overall business operations including advertising and marketing businesses, and to comply with all laws and regulations on the protection of individuals’ rights and personal information. We hereby declare that, in order to comply with the following policy, we shall establish a management system to protect personal information and make company-wide efforts toward continuous improvement while keeping up with trends in IT technologies, social changes and business environments, etc.

  1. We collect, use and provide personal information only to the extent that it is necessary for our legitimate business operation, and recruiting and management of human resources. We shall take measures to prevent usage of personal information for purposes beyond the extent that is necessary for these specified purposes of use.
  2. We shall comply with laws, regulations, guidelines and other standards as stipulated by the government.
  3. We shall continuously improve the personal information security system by allocating resources consistent with the circumstances of the business in order to establish reasonable preventive and precautionary security measures and prevent risks of leakage, loss and damages. In case of an accident, prompt corrective measures will be taken.
  4. We shall respond appropriately and promptly to complaints and inquiries regarding the handling of personal information in a sincere manner.
  5. We shall review management systems for personal information protection in a timely and appropriate manner, and continually improve it with consideration to changes in the business environments.

2. Purpose of using personal information

(1) Purpose of use of personal information of users of services and websites operated and provided by PIALA

  • To deliver services used or materials requested by customers
  • To confirm or provide information that is necessary to provide the services applied for by customers or other matters
  • To ask customers for feedback on the services they have used and their requests to the company
  • To request responses to surveys and other inquiries concerning services used by customers or other matters
  • To provide customers with information on product, services, projects, or events provided by us or a third party by telephone, email, or other means

3. Provision of personal information to third parties

(1) PIALA does not provide personal information to third parties except for in the following cases.

(a) When we have the consent of the individual
(b) When required by laws and regulations
(c) When it is required to protect human life, body, or property, and it is difficult to obtain the consent of the individual
(d) When it is particularly necessary for the improvement of public health or the promotion of the sound upbringing of children, and it is difficult to obtain the consent of the individual
(e) When it is necessary to cooperate in the execution of duties stipulated by law as and entrusted to national organizations, local governments, or agencies, at times when there are concerns that obtaining the consent of the individual in question would pose a hindrance to the execution of said duties
(f) When providing personal information to our group companies located abroad (PG-TRADING Co., Ltd. (China), PG Trading Co., Ltd. (Taiwan), PIATEC(Thailand)Co., Ltd., CHANNEL J(THAILAND)Co., Ltd. (Thailand), PG-Trading(Vietnam)Co., Ltd. (Vietnam)) for use in accordance with the purposes of use described in “2. Purpose of using personal information”

(2) PIALA shall comply with the following items when providing personal information in accordance with (a) or (f) of the preceding paragraph (excluding anonymously processed information).

(a) Record the date of provision to a third party, the name and other information sufficient to identify the third party, the name of the individual to whom the personal information belongs and other information sufficient to identify the individual, and items of personal information provided by the method prescribed by laws and regulations
(b) Retain the record of the preceding item for the period stipulated by laws and regulations

(3) PIALA shall comply with the following when receiving personal information from third parties (excluding anonymously processed information).

(a) Confirm the name and address of the third party from which the personal information is provided, and the name of the representative when the third party is a legal entity in an appropriate manner
(b) Confirm how the personal information was obtained by the third party in an appropriate manner

4. Outsourcing of administration of personal information

PIALA may outsource the administration of personal information for our business operations. In such cases, we shall select an outsourcing contractor with high standards of personal information protection, enter into an agreement for the proper management and confidentiality of personal information, and supervise the implementation of appropriate management.

5. Production, use, and provision to the third party of anonymously processed information

(1) PIALA may produce information that has been processed to make it impossible either to identify a specific individual or to restore the information so that it can be used to identify the individual (hereinafter referred to as “anonymously processed information”) and use it for marketing and other operations. In this case, we shall comply with the following items.

(a) Clearly define the authority and responsibilities of those who handle information relating to processing methods, etc. and establish rules for handling such information
(b) Strive to manage anonymously processed information safely
(c) Not to cross-check anonymously processed information with any other information to identify the individual

(2) When providing anonymously processed information to third parties, PIALA shall disclose items of information to be provided and the method of provision and clearly indicate to the recipient that the information is anonymously processed information.

6. Security Control Measures

In addition to taking the measures as set forth below to prevent the leakage, loss or damage of personal information we handle and other personal information safety management, PIALA shall establish and comply with company regulations such as personal information protection regulations and provide necessary training to all our employees including directors, employees, and temporary employees.

(1) Access control
  A manager and a person in charge of access control shall be appointed and implement access control, including always locking our facilities, prohibition of entry by persons other than those who are authorized, restriction of entry and exit points, keeping entry and exit records, and prohibition of bringing in and out goods.

(2) Information management
  In addition to storing personal information in an appropriate manner, such as limiting storage of materials or recording media containing or recording personal information to lockable facilities, we shall implement information management through appropriate methods, such as restricting the reproduction, or taking or transmitting outside of the company of personal information and disposing of personal information in such a way that does not allow restoration.

(3) Information system management
  We shall implement appropriate management of an information system that handles personal information such as security measures for servers where personal information is stored, establishing appropriate security in the internal network, setting access authorizations, and keeping access records.

(4) Mobile terminal management
  Mobile terminals used by our employees for work shall be limited to those provided by PIALA with appropriate security measures, and we shall provide necessary management and supervision of the use of the mobile terminals by our employees, in addition to prohibiting mobile terminals for personal use.

7. Request for disclosure, etc. of personal information

Individuals may request PIALA to disclose their personal information (including notification and disclosure of purpose of use, correction, addition, deletion, suspension of use, elimination of contents, or suspension of provision to third parties) by contacting our inquiry desk. In such cases, we shall address the matter within a reasonable time period after confirming the identity of the person.

Information on Procedures for Requesting Disclosure, etc.

Regarding the personal data held by PIALA (this refers to personal information that constitutes personal information databases, etc.), we shall handle any requests for (1) notification of purpose of use, (2) disclosure, (3) correction, addition, or deletion of contents (hereinafter referred to as “correction, etc.”), (4) suspension of use or elimination (hereinafter referred to as “suspension of use, etc.”), or (5) suspension of provision to third parties (hereinafter collectively referred to as “request for disclosure, etc.”) from the individual or its representative as follows.
Requests for disclosure, etc. may be made in the following cases, respectively.

Requests may be made at any time. However, in cases where the purpose of use of personal data is clear, or where there is no legal obligation to disclose it, PIALA may not provide notification of the purpose of use.

(2) Disclosure

Requests may be made at any time. However, in cases where such disclosure may harm the life, body, or property, or other rights and interests of the individual or other third parties, where the appropriate implementation of the Company’s operations is likely to be severely disrupted, or where laws and regulations and other rules are likely to be violated, we may not disclose it.

(3) Correction, etc. of contents

Requests may be made in case the contents of personal data held by PIALA are not true.

(4) Suspension of use, etc.

Requests may be made in any of the following cases.

  • In case we handle personal data beyond the scope of the purpose of use
  • In case we use personal data in such a way that is likely to facilitate or induce illegal or wrongful acts
  • In case it is found that we have obtained personal data by wrongful means
  • In case we no longer need to use the personal data
  • In case there is leakage, loss, damage of personal data or any other event related to the security of personal data, which is determined by the rules of the Personal Information Protection Commission to be highly likely to cause harm to the rights and interests of an individual
  • In case the rights or legitimate interests of the individual are likely to be harmed by the handling of personal data

(5) Suspension of provision to third parties

Requests may be made in any of the following cases.

  • In case we provide personal data to a third party in violation of the provisions of “3. Provision of personal information to third parties” in “Handling of Personal Information” above
  • In case we no longer need to use the personal data
  • In case there is leakage, loss, or damage of personal data or any other event related to the security of personal data, which is determined by the rules of the Personal Information Protection Commission to be highly likely to cause harm to the rights and interests of an individual
  • In case the rights or legitimate interests of the individual are likely to be harmed by the handling of personal data
    * Notwithstanding the statements in (4) and (5) above, we may not suspend the use, etc. or the provision to third parties in cases where it costs a large amount of money or is otherwise difficult to discontinue providing the retained personal data concerned to a third party and where we take necessary alternative measures to protect the rights and interests of the individual.

3. PIALA’s designated request forms

(1) For notification of purpose of use
“Request for Notification on Purpose of Use for Personal Information on a Disclosure Target”
(2) For disclosure
“Request for Disclosure of Personal Information on a Disclosure Target”
(3) For correction, etc. of contents, suspension of use, etc., and suspension of provision to third parties

After the submission of the above request form, in order to confirm the identity of individuals, we will inquire about two items of personal information (e.g., telephone number and date of birth, etc.) from among the personal information they have provided to us that can be used to confirm their identity.

4. Fees and payment methods for request for disclosure, etc.

When “notification of purpose of use” or “disclosure” is requested, a fee of 1,100 yen (tax included) will be charged for each request. Payment needs to be made by wire transfer to our financial institution account, which will be communicated separately. Transfer fees are to be paid by the individual. Notification of purpose of use or disclosure will be processed upon confirmation of payment of the fee.

5. Response methods for request for disclosure, etc.

We will respond to individuals by one of the following methods, as specified by them. However, when disclosure by the method specified by the individual would require a large amount of money or when it is difficult to disclose using the method, we shall respond by means of method (1).
(1) By mailing a document to the individual’s address as stated on the request form
(2) By sending an electromagnetic record to the email address designated by the individual
